Protection of Victims of Traffic Accidents

In exceptional circumstances, claims for damages by an injured party are covered by the Austrian Guarantee Fund.

The precondition for this is that an insurer providing motor third-party liability insurance cover is relieved from its liability to pay because the accident was caused by

  • a vehicle that was not (no longer) insured, or not registered for road use
  • a stolen or unlawfully used vehicle
  • an unknown vehicle, or
  • if the damage or injury was caused willfully and unlawfully.

Claims for damages under the terms of the Guarantee Fund must be submitted in writing to:

It is not necessary to assert your claims against the other party prior to any application to the Guarantee Fund.

The VVO can compensate for physical injuries and material loss within the framework of the minimum coverage amounts for third-party motor vehicle insurance at the time of the accident. When an unknown vehicle causes harm or damage (hit-and-run incident), the compensation shall cover material damage only if a person was seriously injured or killed in the accident. In case of material damages (except for damage by an uninsured vehicle) there is a retention of 220 Euros prescribed in the law concerning the guarantee fund.
